THIRD SECTION

DECISION

Applications nos. 64761/13 and 43455/17
Vitaliy Viktorovich STARIKOV
against Russia

The European Court of Human Rights (Third Section), sitting on 5 March 2020 as a Committee composed of:

Alena Poláčková, President,
Dmitry Dedov,
Gilberto Felici, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above applications lodged respectively on 18 September 2013 and 19 April 2017,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant was born in 1980 and lived in Krasnoyarsk.

The applicant’s complaints under Articles 3, 8, 13 and 34 of the Convention concerning the various difficulties affecting his detention in remand prison were communicated to the Russian Government (“the Government”).

On 14 May 2019 the Government informed the Court about the applicant’s death. On 23 May 2019 letters were sent by registered mail to the applicant’s addresses to find out if there was anyone wishing to pursue the case. No reply has been received.

THE LAW

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, the Court concludes that the applicant’s heirs do not wish to pursue the applications within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine, the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.

Accordingly, the cases should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.

Done in English and notified in writing on 26 March 2020.

Liv Tigerstedt Alena Poláčková
Acting Deputy Registrar President
